Terms of Service

1. Agreement to These Terms

These Terms of Service ("Terms") are a legal agreement between you and WriteWith, LLC("WriteWith," "we," "our," or "us"), the owner and operator of PugWriter. They govern your access to the PugWriter websites, web application, desktop application, and related services (collectively, the "Service").

By creating an account, purchasing a subscription, downloading the application, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use PugWriter. If you are not old enough to enter a binding contract where you live, you may use the Service only with permission from a parent or legal guardian who agrees to these Terms. You may not use the Service if doing so is prohibited by applicable law.

3. Accounts and Security

You must provide accurate account information and keep it current. You are responsible for activity under your account and for protecting access to your email, devices, and authentication methods. Notify us promptly at support@pugwriter.com if you suspect unauthorized access.

4. Subscriptions, Billing, and Cancellation

PugWriter may offer free and paid plans. Prices, billing periods, taxes, and plan features are shown before purchase. Paid subscriptions automatically renew for the selected billing period until canceled. You authorize our payment provider to charge your selected payment method for recurring fees and applicable taxes.

You may manage or cancel a subscription from your account billing page. Unless otherwise stated at purchase or required by law, cancellation takes effect at the end of the current paid period and fees already paid are nonrefundable. We may change future prices or plan features after providing notice required by law.

5. Your Content

As between you and WriteWith, you retain ownership of manuscripts, projects, outlines, notes, and other content you submit to the Service ("Your Content"). We do not claim ownership of Your Content.

You grant WriteWith a limited, nonexclusive, worldwide license to host, copy, transmit, display, modify for technical formatting, and otherwise process Your Content only as reasonably necessary to provide, secure, and improve the Service, comply with law, and follow your instructions. This license ends when Your Content is deleted from active systems, subject to reasonable backup and legal-retention periods.

You represent that you have the rights needed to submit Your Content and that doing so does not violate law or another person's rights.

6. AI-Assisted Features

Some features may send your prompts and relevant portions of Your Content to third-party AI providers to generate a response. AI output can be incomplete, inaccurate, or similar to output provided to others. You are responsible for reviewing output and deciding whether it is suitable, lawful, and accurate before relying on or publishing it.

WriteWith does not guarantee ownership, copyright eligibility, or noninfringement of AI-generated output. Additional provider terms may apply when you select or connect a provider.

7. Acceptable Use

You may not use the Service to:

  • Violate law or another person's rights
  • Upload malware or interfere with the Service or its users
  • Gain unauthorized access to accounts, systems, or data
  • Circumvent usage limits, security controls, or access restrictions
  • Scrape, reverse engineer, resell, or exploit the Service except where applicable law expressly permits it
  • Use automated means that impose an unreasonable burden on the Service
  • Use the Service to create or distribute content that is unlawful or infringes intellectual-property, privacy, or publicity rights

8. WriteWith Intellectual Property

The Service, including its software, design, text, graphics, branding, and documentation, is owned by WriteWith or its licensors and is protected by intellectual-property laws. These Terms grant you a limited, revocable, nontransferable right to use the Service for its intended purpose. PugWriter and associated names and logos are trademarks or trade dress of WriteWith. No rights are granted except as expressly stated in these Terms.

9. Third-Party Services

The Service may integrate with or link to third-party services, such as payment processors, source-control providers, and AI providers. Their services are governed by their own terms and privacy notices. WriteWith is not responsible for third-party services that it does not control.

10. Service Changes and Availability

We may update, add, limit, or discontinue features and may release application updates needed for security or compatibility. We work to keep PugWriter reliable but do not promise uninterrupted or error-free availability. Maintain independent backups of writing that is important to you.

11. Suspension and Termination

You may stop using the Service or request account deletion at any time. We may suspend or terminate access when reasonably necessary to address a Terms violation, security risk, legal requirement, nonpayment, or material harm to the Service or others. Where practical, we will provide notice and an opportunity to export Your Content.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available." WriteWith disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the Service or AI output will be accurate, secure, uninterrupted, or error-free. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, WriteWith and its members, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, content, revenue, profits, goodwill, or business opportunity, arising from or related to the Service.

To the fullest extent permitted by law, WriteWith's total liability for all claims relating to the Service will not exceed the greater of the amount you paid WriteWith for the Service in the 12 months before the event giving rise to the claim or US$100. These limitations do not apply where prohibited by law.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless WriteWith and its members, employees, contractors, and suppliers from claims, damages, and expenses arising from Your Content, your misuse of the Service, or your violation of these Terms or another person's rights.

15. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules. Any dispute not resolved informally will be brought in a state or federal court of competent jurisdiction in South Carolina, and each party consents to that jurisdiction and venue. Mandatory consumer protections in your place of residence remain unaffected.

16. Changes to These Terms

We may update these Terms as the Service or law changes. We will post updated Terms with a revised effective date and provide additional notice when required. If you continue using the Service after updated Terms take effect, you accept the updated Terms.

17. General Terms

These Terms and the Privacy Policy are the entire agreement between you and WriteWith about the Service. If part of these Terms is unenforceable, the remaining terms remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, acquisition, or sale of assets.
